These terms and conditions govern the booking and provision of photography and videography services by Joshua Wanjohi Photography ("we", "us", "our") to any individual or organisation ("client", "you") in Kenya. By making a booking, paying a deposit, or engaging our services, you agree to these terms.
1. Bookings and deposits
A booking is only confirmed once a signed agreement (where applicable) and a non-refundable deposit, typically 30% of the total package price, has been received. The remaining balance is due before final image or video delivery unless otherwise agreed in writing.
2. Cancellations and rescheduling
- Deposits are non-refundable, as they secure your date and reserve our team's availability.
- Rescheduling is allowed once at no extra charge, subject to photographer availability, if requested at least 14 days before the original date.
- Cancellations made less than 7 days before the shoot may be liable for the full package fee.
3. Coverage and delivery
We will provide the number of coverage hours, photographers and deliverables agreed in your specific package or quotation. Delivery timelines (sneak peek and full gallery) are estimates and may vary slightly due to shoot complexity, volume of images, or unforeseen circumstances.
4. Client responsibilities
- Provide accurate event details, timelines and venue access information in advance.
- Obtain any permits required by a venue, park authority (such as the Kenya Wildlife Service) or third party for photography.
- Ensure a safe working environment for our team, particularly for outdoor, safari or drone-assisted shoots.
5. Copyright and usage rights
Joshua Wanjohi Photography retains copyright of all images and video produced. Clients booking personal packages (weddings, portraits, family sessions) receive a print release for personal, non-commercial use, including printing, sharing and social media posting with credit appreciated but not required. Commercial clients (brands, lodges, tour operators) receive usage rights as specified in their commercial licensing agreement.
6. Portfolio and marketing use
Unless a client requests otherwise in writing prior to the shoot, we reserve the right to use a selection of images from any session in our portfolio, website, blog and social media for promotional purposes.
7. Liability
While we take extensive precautions with equipment, backups and travel planning, we are not liable for delays or missed coverage caused by circumstances beyond our reasonable control, including extreme weather, venue restrictions, third-party vendor delays, or equipment failure despite reasonable care. Our maximum liability in any dispute is limited to the total amount paid for the specific booking in question.
8. Drone and wildlife photography
Drone operations are conducted only where legally permitted and with appropriate authorisation from relevant authorities and venues. Wildlife photography in national parks and reserves is conducted in accordance with Kenya Wildlife Service and individual conservancy guidelines.
9. Governing law
These terms are governed by the laws of the Republic of Kenya. Any disputes arising from these terms or our services will first be addressed through good-faith negotiation, and if unresolved, referred to arbitration or the Kenyan courts as applicable.
10. Changes to these terms
We may update these terms and conditions periodically. The version posted on this page at the time of your booking will apply to your agreement with us.
