Joshua Wanjohi Photography ("we", "us", "our") respects your privacy and is committed to protecting your personal data in accordance with the Data Protection Act, 2019 of Kenya and the regulations issued by the Office of the Data Protection Commissioner (ODPC). This policy explains what information we collect, why we collect it, and how we use, store and protect it.
1. Information we collect
When you use this website or book a session with us, we may collect:
- Contact details you submit through our booking or contact form, such as your name, email address, phone number and event details.
- Payment-related information you provide when confirming a booking deposit (we do not store full card details on our servers).
- Photographs and video taken during a booked session, which may include images of you, your family, guests or event attendees.
- Basic technical data such as browser type, device type and pages visited, collected automatically to help us improve the website.
2. How we use your information
- To respond to enquiries, confirm bookings and coordinate shoot logistics.
- To edit, deliver and, where agreed, showcase photographs in our portfolio, website or social media.
- To send booking confirmations, invoices and, where you have opted in, occasional updates about our services.
- To maintain records required for accounting and legal compliance in Kenya.
3. Use of images in our portfolio
Unless you request otherwise in writing before your session, we may use a selection of images from your shoot for portfolio, marketing and social media purposes. If you would prefer your images are kept private, let us know in advance and we will exclude them from public use.
4. Sharing your information
We do not sell your personal data. We may share limited information with trusted third parties who help us operate the business, such as payment processors, cloud storage providers for image delivery, and printing labs for album production. These parties are only given the information necessary to perform their service.
5. Data retention
We retain booking records and contact details for as long as necessary to fulfil our contractual and legal obligations, typically up to seven years for financial records. Edited image galleries are generally kept for at least 24 months after delivery, after which older files may be archived or deleted.
6. Your rights
Under the Data Protection Act, 2019, you have the right to:
- Request access to the personal data we hold about you.
- Request correction of inaccurate or incomplete data.
- Request deletion of your data, subject to our legal and contractual obligations.
- Object to or restrict certain uses of your data, including marketing use of your images.
- Lodge a complaint with the Office of the Data Protection Commissioner (ODPC) if you believe your data has been mishandled.
To exercise any of these rights, contact us at [email protected].
7. Cookies and website analytics
This website may use basic cookies or analytics tools to understand how visitors use our site, so we can improve navigation and content. You can disable cookies through your browser settings at any time.
8. Security
We take reasonable technical and organisational measures to protect your personal data and image galleries from unauthorised access, loss or misuse. However, no method of transmission over the internet is completely secure, and we cannot guarantee absolute security.
9. Changes to this policy
We may update this privacy policy from time to time to reflect changes in our practices or legal requirements. The updated version will be posted on this page with a revised "last updated" date.
